Terms and Conditions of Service
These Terms and Conditions govern the provision of waste collection and rubbish removal services by Ben and Jerry. They apply to all customers who book, request, or use our services within the waste collection service area. By making a booking or allowing work to commence, you agree to be bound by these Terms and Conditions.
Please read this document carefully. It sets out the rights and responsibilities of both Ben and Jerry and the customer, ensuring clarity, fairness, and compliance with UK law.
Definitions
For the purposes of these Terms and Conditions, “Ben and Jerry”, “we”, “us”, or “our” refers to the service provider. “Customer”, “you”, or “your” refers to the individual or organisation booking the service. “Services” refers to any waste collection, rubbish removal, clearance, or related activity provided by Ben and Jerry.
Scope of Services
Ben and Jerry provides professional waste collection, rubbish removal, and clearance services for domestic and commercial customers. Services may include, but are not limited to, house clearances, office clearances, builders waste removal, garden waste removal, bulky item collection, and same-day rubbish removal.
All services are provided subject to availability, access, safety considerations, and compliance with waste regulations.
Booking Process
Bookings can be made following a quotation provided by Ben and Jerry. Quotes are based on information supplied by the customer regarding waste type, volume, access, and location.
It is the customer’s responsibility to ensure that the information provided is accurate. If the waste differs materially from the description given, we reserve the right to revise the quotation or decline to remove additional or prohibited waste.
A booking is considered confirmed once accepted by Ben and Jerry. We reserve the right to refuse any booking at our discretion.
Pricing and Quotations
All quotations are provided on a load-based, volume-based, or agreed job basis unless stated otherwise. Prices typically include labour, loading, transport, recycling, and lawful disposal.
Quotes are valid for a reasonable period unless otherwise stated. Prices may be adjusted if circumstances change, including increased waste volume, restricted access, or additional labour requirements. Any adjustments will be explained to the customer before work proceeds.
Payments
Payment terms will be confirmed at the time of booking. Payment may be required in advance, on completion, or in accordance with agreed terms for commercial customers.
Accepted payment methods may include card payments, electronic payments, or bank transfer. Payment must be made in full as agreed. Ben and Jerry reserves the right to withhold services or documentation until payment is received.
Late or unpaid balances may result in additional administrative action.
Cancellations and Rescheduling
Customers may cancel or reschedule a booking by providing reasonable notice. Where insufficient notice is given, a cancellation charge may apply to cover committed resources and costs.
Ben and Jerry reserves the right to cancel or reschedule a booking due to unforeseen circumstances, including vehicle breakdown, staff illness, adverse weather, or safety concerns. In such cases, we will make reasonable efforts to offer an alternative date or solution.
Access and Site Conditions
The customer is responsible for ensuring safe and legal access to the collection location. This includes suitable parking, permissions where required, and clear access to waste items.
If access is restricted, unsafe, or unlawful, we may be unable to carry out the service or may need to revise the scope of work. Delays caused by access issues may affect pricing.
Customer Responsibilities
The customer must ensure that waste presented for collection is legal, non-hazardous unless agreed in advance, and accurately described.
Hazardous materials such as asbestos, chemicals, fuel, explosives, or clinical waste must not be included unless explicitly agreed. Ben and Jerry reserves the right to refuse collection of prohibited items.
The customer must ensure that any items to be removed are owned by them or that they have authority to dispose of them.
Waste Regulations and Duty of Care
All waste is handled in accordance with UK waste regulations. Ben and Jerry operates as a licensed waste carrier and fulfils its Duty of Care obligations.
Customers also have a Duty of Care to ensure their waste is transferred to an authorised carrier. By using our services, customers acknowledge this shared responsibility.
Waste will be taken to authorised transfer stations, recycling facilities, or treatment sites. Recycling and recovery are prioritised wherever possible.
Health and Safety
Ben and Jerry operates with strict health and safety procedures. Our staff are trained and equipped to carry out work safely.
We reserve the right to stop work if conditions are deemed unsafe. This includes risks posed by structural hazards, aggressive behaviour, unsafe waste, or environmental conditions.
Liability
Ben and Jerry holds appropriate insurance for its services. Our liability is limited to direct loss or damage caused by our negligence, subject to the terms of our insurance cover.
We are not liable for indirect or consequential losses, including loss of earnings, business interruption, or delays beyond our reasonable control.
We are not responsible for pre-existing damage to property or items, nor for damage resulting from poor access, concealed hazards, or customer instructions.
Damage and Claims
Any damage alleged to have been caused by Ben and Jerry must be reported as soon as reasonably practicable. Claims should be supported by evidence and made within a reasonable timeframe.
We will investigate all valid claims fairly and in line with our insurance and procedures.
Refusal of Service
Ben and Jerry reserves the right to refuse or discontinue services where terms are breached, payment is not made, waste is misrepresented, or conditions are unsafe or unlawful.
Such refusal does not affect the customer’s obligation to pay for work already completed or costs incurred.
Data Protection
Personal data is handled in accordance with our Privacy Policy and applicable data protection legislation. Information is used only for legitimate business purposes related to service delivery and administration.
Complaints
We aim to provide a professional and reliable service. If you are dissatisfied, we encourage you to raise concerns promptly so they can be addressed.
Complaints will be handled fairly and investigated in line with our internal procedures.
Force Majeure
Ben and Jerry shall not be liable for failure or delay in performance caused by events beyond our reasonable control. This includes, but is not limited to, extreme weather, industrial action, or government restrictions.
Variation of Terms
Ben and Jerry reserves the right to amend these Terms and Conditions from time to time. The version in force at the time of booking will apply.
Severability
If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
Any disputes arising in connection with these Terms and Conditions or the services provided shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By booking or using the services of Ben and Jerry, you confirm that you have read, understood, and agreed to these Terms and Conditions.
